A new federal definition of hemp takes effect November 12, 2026 (some industry groups cite November 13, 2026, based on a differing count of the 365-day implementation window), capping finished consumer products at 0.4 mg of combined total THC and THC-like cannabinoids per container. The change, included in Section 781 of a 2026 federal spending law, redefines hemp by measuring THC as total THC rather than delta-9 only, closing the loophole that allowed delta-8, delta-10, HHC, and high-THCA products to qualify as hemp. The U.S. Hemp Roundtable estimates roughly 95% of today’s hemp-derived cannabinoid products become federally unlawful when the rule takes effect. Florida’s hemp-derived product market is valued in the billions of dollars annually, sold through smoke shops, gas stations, and beverage retailers across the state, with industry economist Whitney Economics estimating statewide retail sales around $6.9 billion a year. Litigation over intoxicating hemp products remains active at the state level, but every proposed fix on the table still targets intoxicating products. Florida’s MMTC framework is not affected by the federal change. Consumers who previously bought intoxicating hemp products at gas stations and smoke shops without a medical marijuana card will need to enter the state’s medical program to access licensed products legally after November 12, making Florida’s state-licensed dispensaries the primary legal destination for that category of consumer.

INVERNESS: CITY COUNCIL ADVANCES BAN ON NEW MEDICAL MARIJUANA DISPENSARIES

The Inverness City Council passed a first reading, 4-1, on an ordinance that would prohibit any additional medical marijuana dispensaries from opening within city limits. The ordinance was set to return July 7 for a final public hearing and adoption vote; as of this writing, final confirmation of that vote’s outcome was not yet available. The ordinance would leave the two existing dispensaries inside city limits unaffected: Trulieve at 950 W. Main St. and Green Dragon at 1500 N. U.S. 41. Residents began pushing the council to act in December, arguing the area already has sufficient dispensary coverage. Council members explored whether Florida law would allow location-specific zoning restrictions before directing staff to draft a ban after learning that while cities can prohibit dispensaries entirely, they have less flexibility to regulate them through zoning standards that treat them differently than pharmacies. Eight medical marijuana dispensaries currently operate across Citrus County. Inverness adopted a dispensary prohibition shortly after Florida authorized medical marijuana treatment centers in 2017, repealed it in 2019, and is now moving to reinstate it. Citrus County and the City of Crystal River already have bans in place.

CLERMONT: FINO CANNABIS OPENS FIRST FLORIDA DISPENSARY WITH WINTER PARK LOCATION PLANNED

FINO’s entry into Central Florida adds a new dispensary to a market currently served by larger established companies. FLORIDA: OMMU DATA SHOWS 932670 ACTIVE PATIENTS AND 10.3 BILLION MG THC DISPENSED IN 2026

Florida’s medical marijuana market has dispensed 10376397800 milligrams of THC year-to-date through June 18, 2026, according to the Office of Medical Marijuana Use (OMMU). The state recorded 429878669 milligrams of THC and 149108.430 ounces of smokable marijuana dispensed during the single week of June 12 through June 18. The active patient registry reached 932670 qualified patients with active ID cards, up from 931252 the prior week, and the number of approved dispensing locations held steady at 767. Trulieve led the market by volume, dispensing 109932287 milligrams of THC from 169 locations during the reporting week. Curaleaf Florida followed at 51476900 milligrams, MÜV at 49556711 milligrams, and Ayr Cannabis Dispensary at 38927847 milligrams. GTI Florida, Surterra Wellness, and FLUENT each reported between 15 and 20 million milligrams for the week. Florida’s program operates under a vertically integrated structure where licensed medical marijuana treatment centers cultivate, process, and dispense cannabis. The state does not impose a statewide excise tax on medical marijuana, and patients are generally allowed to receive up to 2.5 ounces of smokable marijuana every 35 days unless a physician grants an exemption.
